New "Dangerous Goods Road Transportation Management Regulations" Implemented on July 1

On December 31, 2012, the 10th Ministerial Meeting of the Ministry of Transport passed the newly revised “Administrative Regulations on Road Transportation of Dangerous Goods” (hereinafter referred to as “Danger Regulations”) and will be implemented as of July 1, 2013. On June 28, the person in charge of dangerous goods companies organized by the Transportation Management Bureau of Laoshan District held a publicity and implementation meeting.

According to the Chief of the Branch of the Branch’s Transportation Management Division, Mr. Chen Ming, compared with the “Danger Regulations” of the new “Danger Regulations”, the major changes are mainly institutional. The new “Dangerous Regulations” commissioned qualified intermediary agencies to carry out safety evaluation work. Not only can they use social forces to supervise road transport of dangerous goods and reduce the accident rate; they can also scientifically evaluate the safety production status of road transporters of dangerous goods, and are responsible for transportation. The department determines the work objectives and work plan to provide data and conclusion support.

The new “Dangerous Regulations” redefines the number of vehicles for dangerous goods transport companies, the requirements for parking lots, access thresholds for facilities and equipment, defines the requirements for maintenance of dangerous goods vehicles, and sets out more detailed legal responsibilities for dangerous goods consignors. The service standards and safety management system for road dangerous goods transportation have been improved.

The new "Dangerous Regulations" also established the examination system for "highly toxic chemicals and explosives" road transportation personnel and the exemption system for road transport of dangerous goods. Strengthen the safety management of dangerous road transport with dangerous goods, weaken the safety management of dangerous goods transport that have little impact on road transport safety, aim at high risk of “highly toxic chemicals, explosives,” and the life and property of people. Serious damage was caused to the natural environment. It was proposed to establish an examination system for road transport personnel of "highly toxic chemicals and explosives" and to strengthen the management of driving, escorting and loading and unloading management personnel from the source. At the same time, the penalties for failing to provide safety protection facilities for dangerous goods transport vehicles have been added. If a company or unit that violates road dangerous goods transportation or a shipper falls under any of the following circumstances, the road transport administrative agency at or above the county level shall order it to make corrections and impose a fine of 50,000 yuan up to 100,000 yuan, and if it refuses to make corrections, it shall be ordered to suspend production or stop production. If it constitutes a crime, it shall be investigated for criminal responsibility according to law.

Another feature of the new Dangerous Regulations is the concept of source management. Special emphasis was placed on the matching of the total quality of cargo after loading with the authorized cargo quality of special vehicles, as well as the treatment of highly toxic chemicals and explosives, and further standardization of parking requirements.

The new “Danger Regulations” proposed that the total quality of the tanks after cargo loading matches the quality of the authorized vehicles for specific vehicles. At the same time, in the “Application Form for the Management of Road Dangerous Goods Transport”, more specific and easy-to-manage requirements are put forward for the contents of the declaration of tank vehicles. . Through the tank volume, cargo density simply calculate the cargo weight, determine whether the tanker is overloaded, so that "a car, a can, a product", from the source to eliminate the car tank, the nature of overload and so on.

The new “Danger Regulations” treats different vehicles differently according to the different characteristics of special vehicles. In Article 25, it is stated that “Transportation of highly toxic chemicals, explosives-dedicated vehicles and tank-specific vehicles (including tank trailers) should be completed. An enterprise that has the qualification for the maintenance of road transporting dangerous goods vehicles shall carry out repairs, and the tractors and other special vehicles may, after the enterprises eliminate the dangers of dangerous goods by themselves, go to the provisions of the maintenance of the enterprises that have the qualification for general vehicle maintenance.

In addition, the "original risk regulation" on the parking lot can be identified as "with the scope of business, scale," there is no corresponding detailed provisions, the lack of a unified standard of judgment. The new "Danger Regulations" adjusted and refined the requirements for parking lots. The minimum requirements for the parking area shall be clarified, emphasizing that the setting of the parking lot shall not obstruct the production and life of the residents and threaten public safety; and further clarify the requirement that the transport of highly toxic chemicals and explosives shall establish a clear “warning sign” in the parking area; Use a rented parking lot, but limit it to a three-year contract year, and specify the location of the parking lot.
